Flip Dollar Terms and Conditions

1. What is Flip Dollar TM?

Flip DollarsTM is a dual purpose reward program offered by Flip &FlossTM Incorporated (“Flip & FlossTM) that allows kids to redeem their Flip DollarsTM for a cash value or for discounts at Participating Stores (“Participating Stores”), under these terms and conditions (“Terms and Conditions”) available through participating retail locations and websites operating under the Flip & Floss banners (“Participating Stores”).

These Terms and Conditions replace any other terms and conditions that we may have provided to you and govern your participation as a member of Flip & Floss. By participating in the Program, you (or your parent or legal guardian on your behalf, as the case may be), accept and agree to these Terms and Conditions, including as they may be amended from time to time.

2. How Can I Participate?

To participate, you must be a Canadian, US or Jamaican resident, and must obtain the consent of your parent or legal guardian if you are under the age of majority in the province, territory, state or country in which you reside, and such consent is a requirement in the jurisdiction of your residence. Flip DollarsTM is not available to corporations, businesses, charities, partnerships enterprises or anyone other than an individual, unless written approval is received in advance from Flip & Floss in its sole discretion.

3. Earning Flip DollarsTM

There are several ways to earn Flip Dollars™, as set out below.

  1. Taking Courses: In order to receive Flip DollarsTM from completing courses, you must successfully complete a course and pass the quiz. Each successful attempt at a course is worth 100 Flip Dollars.
  2. Completing Tasks Assigned By Parent(s) or Legal Guardian: Flip DollarsTM can be rewarded by parents or legal guardians to child(ren) who successfully complete all their assigned tasks. Parents or legal Guardian who purchased yearly subscriptions to a Flip & Floss plan will receive a 20% discount. Parents and Legal Guardians will also have the ability to purchase additional Flip DollarsTM in their digital wallet on Flip & Floss that they can then use to reward their child(ren) when they successfully complete assigned chores and courses.
  3. Taking Challenges: From time-to-time Flip & FlossTM will offer challenges in the forms of games, quizzes and competitions. When a child successfully meets the requirements, they will be rewarded Flip DollarsTM as outlined in the challenge.

4. Redeeming Flip Dollars™ Points

To “redeem” means to use your Flip DollarsTM to pay, or partially pay, for purchases by using your Flip Debit Card or with Program Participants that offer redemption, following the instructions provided by the cashier, the point-of-sale terminal or other payment processing device. You can redeem Flip DollarsTM you earn for eligible purchases (see section 6 below for exclusions), or for any other purposes of which we may advise you from time to time.

5. Earning and Redemption Exclusions

Flip DollarsTM cannot be earned or redeemed for any of the following: (i) the purchase of tobacco, lottery tickets, or alcohol, (ii) drugs and (iii) other products or services that we may specify from time to time or where prohibited by law.

6. Other Earning and Redemption Rules

In any one transaction, Flip DollarsTM may only be earned on a single Card, and may only be credited to a single Account. While you may not earn the same Flip DollarsTM multiple times by completing the same courses, some transactions may allow you to earn Flip DollarsTM in multiple ways. For example, when a parent or guardian assigns chores or by completing weekly Job Duties, you will receive Flip DollarsTM multiple times from these transactions.

Flip DollarsTM may also be redeemed for purchases made through delivery services by loading your Flip DollarsTM on a prepaid card eligible to make purchases.

If a refund or correction is applied to your Account, your Account balance will be adjusted up or down by the number of Flip DollarsTM related to the refund or correction, as applicable, and your Account balance may become negative.

Our records of the number of Flip DollarsTM earned, redeemed or deducted are deemed accurate. If you have a concern regarding your Account balance, you must contact us and provide relevant evidence within 45 days from the relevant transaction date to report any discrepancy. If we do not hear from you within 45 days, it means you agree with us about your Flip DollarsTM.

The number of Flip DollarsTM displayed on Flip & FlossTM website, email, mobile app or by any other method, is a good reflection of your current Flip DollarsTM balance according to our records. To the extent permitted by law, we accept no liability for any errors on the Flip DollarsTM balance displayed on any website, email, mobile app or other method that is not that of Flip & FlossTM. If any Flip DollarsTM are awarded to your Account in error, we reserve the right to deduct the number of Flip DollarsTM awarded in error at any time and without notice to you. We are not obligated to honour a request to redeem Flip DollarsTM added to an Account in error. We reserve the right to limit Flip DollarsTM awarded with respect to any offer to reasonable household quantities.

We are not responsible for any errors that may occur in the sending or loading of offers or if there is a delay in sending or loading offers. We are not obligated to honour a request to earn or redeem Flip DollarsTM that were not earned or redeemed due to an error or delay in the sending or loading of offers.

If your Card is lost or stolen, contact us to turn off redemption capabilities for that Card. You are responsible for all redemptions on your Account, including any redemptions made on your Account before you turn off redemption capabilities on a Card that was lost or stolen, and all redemptions made on your Account as a result of unauthorized access to your Account, such as due to a failure to safeguard your password.

At the sole discretion of Flip & Floss, you may be permitted to transfer your Flip DollarsTM to another Program member. Upon the death of a Program member, the member’s Account will be closed, unless a designation or assignment of beneficiary form is completed and submitted to Flip & Floss prior to death. If the child(ren) is under the age of majority, the parent who signed up to become a Flip & Floss member will automatically become the beneficiary. The beneficiary will have 90 days from the date of death to redeem all Flip DollarsTM.

Should you choose to close your Account, you will have 90 days to redeem any Flip DollarsTM accumulated in your Account. Any Flip DollarsTM not redeemed after 90 days from the closure of your Account will be forfeited and removed from your Account.

You may donate your Flip DollarsTM to a charity that we may specify from time to time, through your Account online. Contact us for details.

Flip & Floss clarifies that Flip DollarsTM obtained by students via group enrollments (e.g., school programs, charities) lack cash value and are exclusively redeemable on our website as determined by Flip & Floss. Upon program completion, these Flip DollarsTM can't be transferred to a paid subscription. If transfer is desired, the parent or legal guardian must purchase them at $1 per 100 Flip DollarsTM.

7. Pooling Your Flip Dollars™Through a Flip Pool

“Flip Pool” is a group of Flip DollarsTM. Program members having a personal or family relationship that agree to share their Flip DollarsTM.

A Flip DollarsTM member can invite any friend or family member to join their Flip Pool by logging into their online Flip DollarsTM account and following the prescribed steps. After completing the steps, Flip Pool members can safely transfer Flip Dollars from their Program Account to their family or friends. Once their friend or family accepts the transfer, the Flip DollarsTM will be safely deposited in their Flip DollarsTM Program Account. A friend or family member can only join a Flip Pool if they have a Flip Boss Plan with Flip & Floss.

8. Privacy

Flip & Floss Incorporated (“Flip & FlossTM”) and (“Flip AcademyTM”) Privacy Policy (the “Privacy Policy”) applies to the Flip DollarsTM Program and is available at www.flipacademy.ca or upon request. This Privacy Policy may be amended from time to time in accordance with its terms. By agreeing to these Terms and Conditions, you are also agreeing to the terms of the Privacy Policy, and you undertake to review those terms, as such may be amended from time to time.

9. Changes to the Program

We reserve the right to restrict, suspend or otherwise change any aspect, term or condition of the Flip DollarsTM Program. We may modify all or one or more parts of these Terms and Conditions at any time, including, without limitation, the following elements:

In the event the Terms and Conditions, or any aspect of the Flip DollarsTM Program, is restricted, suspended or changed, we will provide you advance notice by posting the amended Terms and Conditions online at www.flipacademy.ca, and by sending you notice using your email or mailing address. Your continued participation in the Flip DollarsTM Program following such notice will constitute your consent to any amendments to these Terms and Conditions, or any other aspect of the Flip DollarsTM Program. In the event that the amendment entails an increase in your obligations or a reduction in our obligations and you do not agree to such amendment, you may close your Account and cancel your participation in the Flip DollarsTM Program without cost or penalty. You will then have 90 days to redeem any Flip DollarsTM in your Account. Any Flip DollarsTM that are not redeemed after 90 days will be forfeited.

10. General

By participating in any aspect of the Flip DollarsTM Program, you (and your parent or legal guardian on your behalf, as the case may be) agree to be bound by these Terms and Conditions. These Terms and Conditions may be amended from time to time, and you should check www.flipacademy.ca regularly for any updates.

Unauthorized reproduction of any Card is prohibited and can result in legal prosecution. All Cards belong to us and may be revoked at any time at our sole discretion.

You are responsible for protecting and keeping secure your Account and Cards on your Account and any password or security questions used in connection with your Account and Cards.

We reserve the right to terminate the Flip DollarsTM Program, or any part of it, at any time on 45 days prior written notice (to be provided on our websites, or through other communications to Flip DollarsTM Program members, including via email). If the Flip DollarsTM Program is terminated, you will have up to 90 days after the effective termination date to redeem any Flip DollarsTM in your Account. After the expiry of the 90-day period, any Flip DollarsTM that have not been redeemed will be forfeited.

We reserve the right to sell or transfer all or part of the Flip DollarsTM Program to a related company or to a third party, to merge with another entity or to engage in any form of corporate, reorganization or financing transaction. In addition, the manner in which the Flip DollarsTM Program is provided to you and the organizations providing offers in connection with the Flip DollarsTM Program may change. Please refer to our Privacy Policy at www.flipacademy.ca for details as to how your personal information would be handled in such cases.

If any of the information you were required to submit when you registered for the Flip DollarsTM Program changes (such as your name, mailing address, email address or phone number), you must let us know immediately and give us your current information. We are not responsible if we cannot contact you because you have not given us current, accurate information.

We reserve the right to refuse to allow you or any person you seek to add to your Account to join the Flip DollarsTM Program for any reason in our sole discretion, including for not meeting the eligibility requirements or for having a membership cancelled previously.

We may, at any time, suspend or cancel your participation in the Flip DollarsTM Program, if, in our view, you have abused any Flip DollarsTM Program privilege, failed to follow these Terms and Conditions, or made any misrepresentation to us or to any entity associated with or participating in the Flip DollarsTM Program. In the event that your participation in the Program is cancelled, all accumulated Flip DollarsTM in your Account may also be forfeited and removed from your Account.

To the extent permitted by law, by participating in the Flip DollarsTM Program, you (and your parent or legal guardian on your behalf, as the case may be) agree to release and discharge Flip & Floss and any other third party that may from time to time participate in the Flip DollarsTM Program (whether as a participant or in an administrative, operational or other capacity), and Flip & Floss, and each of their respective officers, directors, agents, representatives, successors and assigns, from any loss, liability, claim, demand, damage or expense asserted by any person or entity relating in any way to the Flip DollarsTM Program, your participation in the Flip DollarsTM Program or the redemption and use/misuse of any item obtained through the redemption of  Flip DollarsTM or otherwise in connection with the Flip DollarsTM Program.

We reserve the right to withdraw or temporarily change or suspend all or part of the Flip DollarsTM Program in any way, in the event of a material error, omission, technical problem, computer virus or bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond our reasonable control that interferes with the proper conduct of any aspect of the Flip DollarsTM Program as set out in these Terms and Conditions. Any attempt to deliberately damage any website or to undermine the legitimate operation of the Flip DollarsTM Program in any way (as we may determine in our sole discretion) could be a violation of criminal or civil laws and should such an attempt be made, we reserve the right to seek remedies and damages to the fullest extent permitted by law.

Our failure to exercise any of our rights, powers or remedies in these Terms and Conditions or at law, or any delay in doing so, does not constitute a waiver of those rights, powers or remedies. The single or partial exercise of a right, power or remedy does not prevent its subsequent exercise or the exercise of any right, power or remedy.

Words in the singular form shall be construed to include the plural and vice versa, unless the context otherwise requires, and the word “including” means “including but not limited to”. Any dollar amounts referenced in connection with the Flip DollarsTM Program or these Terms and Conditions are referenced in Canadian dollars.

Each of the provisions contained in these Terms and Conditions is distinct and severable and a declaration of invalidity or unenforceability of any such provision or part thereof by a court of competent jurisdiction will not affect the validity or enforceability of any other provision of these Terms and Conditions.

11. Governing Law and Dispute Resolution

These Terms and Conditions are governed by the laws of the province of Ontario and the federal laws applicable in Ontario, without reference to conflict of laws provisions. However, in respect of residents of Quebec, these Terms and Conditions are governed by the laws of the Province of Quebec and the federal laws applicable in Quebec.
